Pursuant to the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), a copyright owner or their agent may submit a takedown notice to us via the contact information provided below.
As an internet service provider, Cyvion – Digital Growth is entitled to claim immunity from copyright infringement claims under the DMCA’s “safe harbor” provisions. To file a good faith infringement claim, please submit a notice that includes the following:
Notice of Infringement – Claim
To be effective, your DMCA takedown notice must include:

A physical or electronic signature of the copyright owner (or someone authorized to act on their behalf).

Identification of the copyrighted work claimed to have been infringed.

Identification of the infringing material to be removed, including the URL or location of the material on our site.

Sufficient information to contact the complaining party: name, physical address, phone number, and email address.

A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.
Note: Title 17 USC §512(f) provides for civil penalties (including damages and attorney’s fees) against any person who knowingly and materially misrepresents information in a DMCA notification.

Counter Notification – Restoration of Material
If your material has been taken down due to a DMCA complaint, and you believe it was done in error or misidentification, you may submit a counter notification including the following, per 17 USC §512(g)(3):

Your physical or electronic signature.

A description of the material that was removed and the original URL/location.

A statement, under penalty of perjury, that you have a good faith belief that the material was removed by mistake or misidentification.

Your name, address, phone number, and a statement that you consent to the jurisdiction of the federal district court in your area (or any jurisdiction if outside the U.S.), and that you will accept service of process from the person who submitted the original takedown notice.

Repeat Infringer Policy
Cyvion – Digital Growth maintains a policy to terminate accounts of repeat infringers, as required by the DMCA. We track takedown requests and make a good faith effort to identify and remove repeat violators.
